By accessing or using Artio, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules posted within the App. These Terms apply to all users, including those who use the free features and those who purchase a subscription.
You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use Artio. If you are under 18, you represent that you have obtained parental or guardian consent to enter into these Terms.
Artio is a creative mobile application that provides two primary features:
The App is made available through Apple's App Store. Certain premium features or content may require an active subscription as described in Section 5 below.
Artio may not require a traditional account with username and password. However, you are responsible for:
Your Content: You retain all rights and ownership to the photos you provide and the coloring pages or sketches you create using Artio ("User Content"). Artio does not claim any ownership over your User Content. By using the App, you grant us a limited, non-exclusive, royalty-free license to process your User Content solely as necessary to provide the App's features (e.g., running on-device AI to generate coloring outlines). This license ends when you delete the User Content from the App or uninstall the App.
Our Content: All intellectual property rights in the App itself, including but not limited to its source code, design, UI/UX, logo, branding, underlying AI models, algorithms, and documentation, are and shall remain the exclusive property of Artio. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works based on the App or any part thereof.
Feedback: If you provide us with any feedback, suggestions, or ideas regarding the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback into the App without any compensation or obligation to you.
Artio offers auto-renewable subscription plans that unlock premium features. All subscription management is handled exclusively by Apple through your Apple ID account.
Price Changes: We reserve the right to modify subscription pricing at any time. Any price change will be communicated to you in advance through the App or via the App Store. Continued use after a price change constitutes acceptance of the new pricing.
Refunds: All subscription payments are processed by Apple. Refund requests must be made directly to Apple through their support channels. Artio does not have the ability to issue refunds for App Store purchases. Please review Apple's refund policy at Apple's support page.
Artio may offer a limited set of features at no cost. We reserve the right to modify, expand, or reduce the scope of free features at any time without prior notice. Premium features require an active, paid subscription as outlined in Section 5.
The App may contain links to third-party websites or services (e.g., Apple's App Store, support pages). We do not own or control these third-party services and are not responsible for their content, privacy practices, or terms. Your interactions with third-party services are governed by their respective terms and policies.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARTIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
You use Artio at your own discretion and risk. You are solely responsible for any damage to your device or loss of data that may result from using the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTIO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
In any case, our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to Artio in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars ($50.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Artio and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms remain effective until terminated by either party. You may terminate these Terms at any time by uninstalling the App and cancelling any active subscriptions through your Apple ID settings. We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.
Upon termination, all rights granted to you under these Terms cease immediately. Sections concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in such courts.
For users outside the United States: You may also be entitled to the protection of mandatory consumer protection laws in your country of residence. Nothing in these Terms limits your rights under such laws.
Informal Resolution: Before initiating any formal legal action, we encourage you to contact us at support@artio-app.com to attempt to resolve the dispute informally. We will make reasonable efforts to address your concerns within 30 days.
We reserve the right to modify or update these Terms at any time. When we make material changes, we will notify you within the App or via email (if provided) and update the "Effective Date" at the top of this page. Your continued use of Artio after any such changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App and cancel any active subscriptions.
We encourage you to review these Terms periodically. The most current version will always be available within the App and on our designated legal page.
